The following traffic violations are not eligible for diversion:
- fleeing to elude
- drag racing
- speeding in a school or construction zone
- failure to yield to an emergency vehicle
- reckless driving
- improper passing of a school bus
If you have a commercial driver’s license (CDL), you are not eligible for traffic diversion, regardless of whether you were driving a commercial vehicle at the time of the ticket.
If you have any prior traffic convictions or diversions within the past year, you are
not eligible for diversion.

This program is for qualified defendants who have been charged with a DUI for the first time, and the charges are filed in the District Court of Wyandotte County, KS.
The District Attorney’s Office will not prescreen or opine about the defendant’s eligibility, potential approval, or other consideration until application has been made and the application fee has been paid.
You are not eligible for diversion if, at the time of the offense, you were involved in a motor vehicle accident or collision resulting in personal injury or death.
