Diversion

Overview

Our Diversion programs provide an alternative to prosecution for qualifying defendants and prompt repayment of restitution to victims.

Diversion refers defendants in criminal cases to a supervised performance program before adjudication. If a defendant fulfills all the terms and conditions set for in a diversion agreement, all charges against him or her will be dismissed. All authority for diversion lies with the District Attorney. Disposing of cases through diversion must be in the interests of justice and benefit the defendant and the community.

Traffic

The following traffic violations are not eligible for diversion:

  • Fleeing to elude
  • Drag racing
  • Speeding in a school or construction zone
  • Failure to yield to an emergency vehicle
  • Reckless driving
  • Improper passing of a school bus

If you have a commercial driver’s license (CDL), you are not eligible for traffic diversion, regardless of whether you were driving a commercial vehicle at the time of the ticket.

If you have any prior traffic convictions or diversions within the past year, you are not eligible for diversion.

Pay the $50 non-refundable application fee:

  • In Person at the Wyandotte County Courthouse, Traffic Department

If you are applying for diversion, do not pay the fine listed on the citation.

How to Apply

Submit a completed application to the Diversion Services Unit:

Applications are accepted until (2) weeks after a defendant’s first scheduled court appearance.

Criminal

This program is for qualified defendants.

The District Attorney’s Office will not prescreen or opine about the defendant’s eligibility, potential approval, or other consideration until the application has been made and the application fee has been paid.

Pay the non-refundable application fee:

  • $90 for misdemeanors, $100 for felonies
  • Application fee must be paid to the Clerk of the District Court
  • Submit proof of payment with application to the Diversion Services Unit

DUI

This program is for qualified defendants who have been charged with a DUI for the first time, and the charges are filed in the District Court of Wyandotte County, KS.

The District Attorney’s Office will not prescreen or opine about the defendant’s eligibility, potential approval, or other consideration until the application has been made and the application fee has been paid.

You are not eligible for diversion if, at the time of the offense, you were involved in a motor vehicle accident or collision resulting in personal injury or death.

Pay the $125 non-refundable application fee:

  • In person to the Clerk of District Court at the Wyandotte County Courthouse
  • Submit proof of payment with application to the Diversion Services Unit

This program is for qualified defendants.

  • $130 Application Fee
  • You must pay $30 at the time of submission of the application to the Clerk of the District Court, and the remaining $100 will be paid during the diversion period if approved.
  • Submit proof of payment with application to the Diversion Services Unit
